In Arizona, it is illegal to operate a motor vehicle while under the influence of alcohol or drugs that impair one’s ability to drive safely.

The legal blood alcohol concentration (BAC) limits are:

Regular drivers: BAC of 0.08% or higher
Commercial drivers: BAC of 0.04% or higher
Under 21 drivers: Any trace of alcohol in their system (zero tolerance policy)

The penalties for a DUI offense in Arizona depend on several factors, including the driver’s BAC, the presence of any prior DUI convictions, and the severity of the offense.

Here’s a general outline of the penalties for a first-time DUI offense in Arizona:

First Offense (Non-Extreme or Super Extreme DUI):

Jail time: Minimum 10 days in jail (or 9 days with alcohol counseling)
Fines: At least $1,480
License suspension: 90 to 360 days
Ignition Interlock Device (IID): Required for a minimum of 6 months (for BAC of 0.15% or more)
Alcohol or drug education/treatment program: Mandatory attendance
Probation: Up to 5 years

Extreme DUI (BAC of 0.15% to 0.199%):

Jail time: Minimum 30 days in jail (or 21 days with alcohol counseling)
Fines: At least $3,000

Super Extreme DUI (BAC of 0.20% or higher):

Jail time: Minimum 45 days in jail (or 30 days with alcohol counseling)
