The Arizona Revised Statutes (ARS) 13-1304 defines kidnapping. A person can be charged with the offense if they “knowingly restrain another person” with the intent of:

• Placing the victim or another person in “reasonable apprehension of imminent physical injury” to the victim or other person

Class 3 charges apply if the alleged offender releases the victim, again uninjured, and as a result of an agreement with the State. When victims are under age 15, kidnapping is a class 2 felony.
