Arizona has strict open container laws that make it illegal for a person to drive with an alcoholic beverage in their vehicle that has been opened, even if the alcohol is not being consumed. Therefore, it is also illegal for passengers to consume alcohol in the car. It is also against the law for anyone, including backseat passengers, to drink an alcoholic beverage while a motor vehicle is on a public road.
Open container offenses can result in a class 2 misdemeanor and, if convicted, a fine of up to $750. If a minor is caught with an open container, they could face up to four months in jail, along with hefty fines.
